Restaurant Payroll: Taking the Tip Credit

We’ve seen recently that restaurant payrolls are on the rise, according to the U.S. Department of Labor’s job reports. If you work with or for a restaurant business, it’s important to understand some of the payroll requirements involved

The Federal Labor Standards Act (FLSA) allows employers to pay $2.13 per hour when tipped employees receive at least $30 in tips during a month. This is how restaurateurs avoid paying the typical minimum wage of $7.25, however their employees’ regular rate of pay needs to add up to that amount. If the state has a higher minimum cash wage than the federal, the state law overrides the federal. 

It’s important to note that laws may vary from state-to-state.
